Terms and Conditions

Scope of application

These General Terms and Conditions ("GTC") apply to the business division of Basalt Fibertec GmbH, Eisenbahnstrasse 25, CH-4900 Langenthal. These GTC apply to all areas as well as further services which Basalt Fibertec GmbH provides directly and indirectly to the customer.

Binding nature

The order shall become binding for Basalt Fibertec GmbH with the written order confirmation. The customer shall check this confirmation and notify Basalt Fibertec GmbH immediately of any discrepancies.

Delivery

As far as possible, the confirmed delivery dates shall be adhered to. However, the delivery date is not an expiry date. A change of date does not entitle the customer to renounce the delivery and to claim damages. The delivery takes place at the risk of the customer, respectively the recipient. Complaints Upon receipt of the goods, the recipient must immediately check them for completeness and integrity. Any complaints must be made as a reservation on the shipping documents and must be reported to Basalt Fibertec GmbH within 24 hours.

Prices

The prices are based on the price list valid at the time of delivery. Basalt Fibertec GmbH expressly reserves the right to make corresponding changes to the order confirmation. Value added tax is not included in the prices and will be charged additionally.

Payment

In case of exceeding the agreed term of payment, Basalt Fibertec GmbH reserves the right to postpone already confirmed delivery orders.

Warranty

Basalt Fibertec GmbH warrants the quality of its products. These shall be inspected prior to dispatch or delivery. The recipient of the goods must check the quality of the products upon receipt. Any defects must be reported to Basalt Fibertec GmbH within 8 days. The warranty shall only cover the replacement of the products recognized as defective by Basalt Fibertec GmbH. Further warranty claims and claims for damages are excluded. Basalt Fibertec GmbH disclaims any liability for the use of defective products as well as for any damage resulting therefrom. In order to guarantee the traceability of the products, the customer has to keep the package labels with the product designations.

Returns

Return shipments of rejected or defective goods have to be agreed upon with Basalt Fibertec GmbH in advance.

Applicable law and place of jurisdiction

The contractual relationship between the customer and Basalt Fibertec GmbH shall be governed by Swiss law - excluding the United Nations Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is Burgdorf, Switzerland.
